The introduction of the Yukon’s Extended Producer Responsibility (EPR) regulations for Household Special Products (HSP) represents a significant shift in regulatory requirements for producers in the territory and requires our members’ immediate attention.
Product Care has engaged extensively with both the Yukon Government and members to ensure a thorough understanding of the regulatory framework. These conversations have been instrumental in identifying key challenges and opportunities related to program development and implementation.
At this time, Product Care Recycling is seeking input from our members to:
- Obtain a mandate to submit a stewardship plan for the Territory’s HSP program, and
- Indicate their preference on the program’s funding model

VOTE 1: Mandate to proceed
Producers have the choice in how they comply with EPR regulations and are therefore not obligated to work with a Producer Responsibility Organization (PRO), such as Product Care. Members are asked to vote for their preferred option:

| Appoint Product Care to act on the member’s behalf to comply with YK EPR regulations | Fund their own program to comply with YK EPR regulations | Stop selling products in Yukon, thereby eliminating the need to comply with YK EPR regulations |
If a member opts for Option A, they will be required to participate in Vote 2.
VOTE 2: Funding model
As previously communicated, multiple challenges impact the financial sustainability of this program. To attempt to accommodate these realities and support program delivery, Product Care is proposing new funding models for our members’ consideration:

| Set EHFs at 6-7x the rate of other Canadian programs, with annual true-up payment by program members to fund any deficits that may arise. | Set EHFs at 3x the rate of other Canadian programs, with higher annual true-up payment by program members to fund any deficits that may arise. |
Note:
Product Care, and the Yukon Government, will revisit program requirements on an annual basis to ensure program sustainability. It is possible that neither option results in long-term program sustainability. Product Care reserves the right to withdraw from the Program, regardless of the option selected.
