Lights (Lamps) Program Overview

On July 15, 2024 New Brunswick’s Designated Materials Regulation (2024-37) was amended under the Clean Environment Act (O.C. 2024-166) obligating lamps as a designated material.

Product Care is assisting producers in complying with the New Brunswick Designated Materials Regulation as a Producer Responsibility Organization (PRO).

In December 2024, Product Care submitted a Lamp Stewardship Plan on behalf of members to the province’s stewardship board, known as Recycle New Brunswick (Recycle NB). Pending approval of the plan by Recycle NB, the program is expected to start in the second half of 2025.

Obligated “Producers”

The amended regulation changed the obligated party definition from “brand owner” to “producer”. The regulations (section 4(2)) define a producer, for lamps, in a hierarchal manner, as:

a) the brand holder of the designated material if the brand holder has a permanent establishment in Canada;

b) in the absence of a person referred to in paragraph (a), the importer of the designated material into New Brunswick if the importer has a permanent establishment in New Brunswick;

c) in the absence of a person referred to in paragraph (a) or (b), the retailer of the designated material that supplies the designated material to the consumer.

IMPORTANT: All producers must register with Recycle NB to sell lamp products in the province. The deadline to register with Recycle New Brunswick was October 1, 2024.

Recycle NB Registration

All producers must register with Recycle NB to sell lamp products in the province. The deadline to register with Recycle NB was October 31, 2024. If you have not already done so, please register immediately as you may be subject to regulatory penalties if your registration is not received.

Registration is to be completed through Recycle NB’s online form. A hard-copy registration form can also be found here.

Product Care Registration

Producers must also register with Product Care to officially become a member of the NB Lights Program. Product Care’s internal registration and reporting system for the NB Lights Program is currently in development. Once finalized, members will be contacted and invited to register and report sales and fees for the program using the same system that is in place for existing Product Care lights programs (eg. In BC, Manitoba, Quebec, Nova Scotia etc.).
